1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Lyria 3 (https://lyria-3.pro, "Lyria 3", "we", "us", "our"). By creating an account, purchasing credits, subscribing, or using any feature, you agree to be bound by these Terms.

If you do not agree, do not use the Service.

2. Eligibility and Account Responsibilities

• You must be legally capable of entering into a binding contract in your jurisdiction.
• You must provide accurate registration information and keep it updated.
• You are responsible for all activities under your account and for keeping credentials secure.
• You must notify us immediately at support@lyria-3.pro if you suspect unauthorized account access.

A verified account that has never completed a payment may be scheduled for deletion after at least 30 consecutive days without recorded account activity. We provide at least 30 days' advance notice and a further reminder approximately 7 days before deletion. Signing in or confirming that you want to keep the account cancels the schedule. We recheck eligibility immediately before deletion. Accounts with payment history, an active subscription, a refund, chargeback, payment dispute, or a legal/accounting retention requirement are excluded. Unused free, trial, referral, or promotional credits do not prevent deletion and expire when the account is deleted.

3. Service Description

Lyria 3 provides AI-powered generation and processing tools, including image, video, audio/music, and related creative workflows. Features, model availability, performance, and limits may change over time.

We may add, remove, or modify features at any time to maintain security, reliability, legal compliance, and product quality.

4. Credits, Subscriptions, and Renewals

• Credits are consumable units used by generation and processing tasks.
• Subscriptions may include recurring credits and premium capabilities.
• Subscription plans automatically renew at the end of each billing cycle unless canceled before renewal.
• Canceling a subscription prevents future renewal charges; cancellation does not retroactively undo already billed periods.
• Credits and subscription benefits are non-transferable, non-exchangeable, and have no cash value unless required by law.

5. Payments and Taxes

• You authorize us and our payment providers to charge all applicable fees for selected plans and usage.
• Prices may change with notice before a new billing cycle begins.
• You are responsible for applicable taxes, duties, and government charges unless stated otherwise.

6. Refunds

Refunds are governed by our Refund Policy, which is incorporated into these Terms.

In case of conflict between this section and the Refund Policy regarding refund mechanics, the Refund Policy controls.

7. Acceptable Use and Prohibited Conduct

You may not use Lyria 3 to:

• Violate any applicable law or regulation.
• Create, distribute, or promote child sexual abuse material, non-consensual sexual content, or exploitative content.
• Generate illegal, fraudulent, deceptive, or malicious content (including phishing, scams, malware, impersonation, or forged documents).
• Infringe intellectual property, privacy, publicity, or other rights.
• Evade safeguards, abuse limits, scrape or reverse engineer systems, or interfere with platform operation.
• Operate automated high-volume abuse workflows (including bots/scripts) that materially harm service stability or fairness.

We may investigate and take action, including content removal, feature restriction, suspension, termination, and reporting to authorities where appropriate.

8. User Content and AI Output

• You are responsible for ensuring you have rights to all inputs you upload or submit.
• You retain ownership of your lawful inputs and outputs, subject to these Terms and applicable law.
• For outputs generated under an eligible paid plan, we permit the account holder that generated the output to use that lawful output in personal and commercial projects, subject to these Terms, applicable law, third-party rights, and any provider-specific restrictions.
• Outputs generated through free trials, free credits, or other no-charge access do not include a separate written commercial-use release unless we expressly state otherwise for that specific offering.
• Any usage permission we provide applies only to our Service. We do not issue legal releases, indemnities, or authorizations on behalf of Google, Google DeepMind, or any other third-party provider.
• You grant us a limited license to host, process, transmit, and display your content as needed to operate, secure, and improve the Service.
• AI outputs may be non-unique, inaccurate, or unsuitable for specific legal, medical, financial, or safety-critical decisions. You are responsible for human review before use.

9. Third-Party Services

Lyria 3 may integrate third-party model providers, payment processors, and infrastructure services. Use of those services may also be subject to their terms and policies.

10. Suspension and Termination

We may suspend or terminate access immediately if:

• You materially breach these Terms.
• Your use creates legal, security, or abuse risks.
• We are required to do so by law.

You may stop using the Service at any time. On termination, some data may be retained as required by law or for legitimate security/business purposes.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

12. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
• Our aggregate liability for claims relating to the Service will not exceed the amount you paid to Lyria 3 in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some parts may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Lyria 3, its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and costs (including reasonable legal fees) arising out of:

• Your content,
• Your use of the Service,
• Your violation of these Terms, or
• Your violation of any law or third-party rights.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction where the Service operator is established, excluding conflict-of-laws rules, unless mandatory local consumer law provides otherwise.

Any dispute not resolved informally may be submitted to binding arbitration or competent courts in that jurisdiction, subject to applicable law.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes become effective means you accept the revised Terms.
